GENERAL TERMS AND CONDITIONS

Scope
These General Terms and Conditions (following"GTC") apply to all contracts concluded by Vitnir Clothing (following "Vitnir") with individuals or companies domiciled or based in Switzerland (following "Customer") for products offered on the Vitnir webshop (following "Webshop"). By placing an order on Vitnir's Webshop, the Customer accepts these GTC. Deliveries, services, offers, etc. from Vitnir via the Webshop are exclusively subject to these GTC. The GTC apply in the respective version current at the time of conclusion of the contract. Vitnir reserves the right to change these GTC at any time.
User Account / Customer Information
The Customer places orders via a user account or as a guest on Vitnir's Webshop. All information provided by the Customer in the user account and as a guest must be complete and accurate. Each Customer may only open one user account.
Conclusion of Contract and Delivery
The contract between Vitnir and the Customer is only concluded upon explicit order confirmation (not through the automated summary of the order sent by email) or upon shipping confirmation from Vitnir, and is subject to the availability of the ordered products. Until the time of explicit order confirmation or shipping confirmation by Vitnir, the buyer is bound to the order. Vitnir's offer is primarily aimed at end consumers, which is why Vitnir reserves the right to not fulfill or reject orders, especially if non-consumer quantities of products are ordered from Vitnir's perspective. The prices in Swiss Francs, including VAT and shipping costs, stated in the Webshop at the time of ordering apply to the products ordered by the buyer. The shipping costs are separately stated during the ordering process and in the order confirmation. Vitnir only delivers to addresses within Switzerland. The shipping method and packaging type are determined by Vitnir. Delivery dates and/or deadlines provided or communicated by Vitnir are non-binding. If delays exceed 30 days or if delivery is impossible for more than 30 days, the Customer and Vitnir have the right to withdraw from the contract without compensation.
Payment Terms
Payment for all orders must be made in Swiss Francs, either via Twint or by credit card. In the case of payment by invoice, ownership of the delivered goods only passes to the Customer upon full payment of the purchase price.
Liability / Compensation
Any discrepancies in the delivery address must be communicated to Vitnir in writing by email within 5 calendar days of receiving the shipping confirmation. Vitnir solely warrants that the ordered products do not have any defects in materials and/or workmanship at the time of delivery to the Customer. Other services, especially compensation, are excluded in the event of a defect. Vitnir Clothing also rejects any compensation in the case of a wrong order, such as wrong size or wrong color. By making the purchase, the Customer undertakes to use the products solely for their intended purpose.
Data Security and Data Protection
Data transmission is carried out via the internet. The internet is an open network accessible to everyone and is therefore generally not considered a secure environment. All payment transactions are conducted according to the customary security standard ("https://") at the time of the transaction. Vitnir disclaims any liability for the security of data during its transmission via the internet. The processing of personal data is carried out in accordance with and in compliance with the applicable data protection regulations for the purpose of contract processing and maintaining customer relationships (including marketing measures). The disclosure of the Customer's personal data to third parties outside the Vitnir Group is exclusively to service partners involved in the execution of the contract, such as the logistics company entrusted with the delivery. In such cases, the scope of the transmitted data is limited.
Applicable Law and Jurisdiction
The contractual relationship, including these Terms, is subject exclusively to Swiss law, excluding the conflict of laws provisions of Swiss international private law, in particular excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Baden, Canton of Aargau, Switzerland, whereby Vitnir is entitled to sue the Customer at their general place of jurisdiction.
